Loan Factory Terms of Service

1. Acceptance of Terms

By accessing or using Loan Factory (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of the Service

Loan Factory — also offered under the product name "Ally" — is a marketing tool that helps businesses and individuals draft, schedule, and publish content to third-party social platforms, including TikTok, and send email from their own Gmail account. To use TikTok features, you connect your TikTok account via TikTok's official OAuth flow, and Loan Factory publishes content to TikTok on your behalf using TikTok's official Content Posting API. To use Gmail features, you connect your Google account via Google's official OAuth flow, and Loan Factory sends the emails you compose from your Gmail account using Google's official Gmail API.

3. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction (whichever is greater), to use the Service. You must also comply with the eligibility requirements of any third-party platform you connect — including TikTok's own Terms of Service and Community Guidelines.

4. Your TikTok Account

When you connect your TikTok account to Loan Factory:

• You grant Loan Factory limited access to publish videos to that TikTok account, on your explicit instruction, using TikTok's Content Posting API.
• You retain full ownership of all content you publish.
• You are solely responsible for the content you publish through Loan Factory, including its compliance with TikTok's Community Guidelines, applicable laws, and third-party rights.
• You may disconnect your TikTok account at any time from Loan Factory's settings page. Disconnection revokes Loan Factory's access tokens immediately.

5. Your Google (Gmail) Account

When you connect your Google account to Loan Factory:

• You grant Loan Factory limited access to send email from that Gmail account, on your explicit instruction, using Google's Gmail API. Loan Factory does not read your mailbox.
• You retain full ownership of every message you send.
• You are solely responsible for the emails you send through Loan Factory, including their compliance with Google's terms, applicable anti-spam and consumer-protection laws (such as CAN-SPAM), and the rights of recipients.
• You may disconnect your Google account at any time from the settings page, or revoke access from your Google Account settings.

Your use of Gmail through Loan Factory is also subject to:

• Google Terms of Service
• Google Privacy Policy
• Google API Services User Data Policy

In the event of a conflict between these Terms and Google's terms regarding your use of Google services, Google's terms govern your relationship with Google.

6. Acceptable Use

You agree not to use the Service to:

• Publish content that violates TikTok's Community Guidelines, Terms of Service, or applicable law.
• Impersonate any person or entity, or misrepresent your affiliation.
• Attempt to circumvent TikTok's rate limits, automation policies, or other technical restrictions.
• Use the Service to publish spam, harassment, hate speech, sexually explicit content involving minors, or content promoting violence.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Send unsolicited bulk email, deceptive or misleading messages, or any email that violates Google's Gmail policies or applicable anti-spam law.

Loan Factory may suspend or terminate your access if you violate this section, with or without notice.

7. TikTok Integration — Specific Terms

Your use of TikTok-related features is also governed by:

• TikTok's Terms of Service
• TikTok's Community Guidelines
• TikTok's Developer Terms of Service

In the event of a conflict between these Terms and TikTok's terms regarding your use of the TikTok platform, TikTok's terms govern your relationship with TikTok.

8. Intellectual Property

The Service, including its software, design, and trademarks, is owned by Loan Factory, Inc. and protected by intellectual-property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.

You retain all rights to the content you publish. By using Loan Factory to publish to TikTok, you authorize Loan Factory to transmit that content to TikTok on your behalf.

9. Disclaimers

The Service is provided "as is" and "as available," without warranty of any kind. Loan Factory does not guarantee that publishing requests will always succeed — TikTok may reject, delay, or remove content for reasons outside Loan Factory's control (rate limits, policy violations, platform outages, etc.).

To the maximum extent permitted by law, Loan Factory disclaims all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, Loan Factory shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service.

11. Termination

You may stop using the Service at any time. Loan Factory may suspend or terminate your account if you violate these Terms or if continued operation poses a legal or security risk.

12. Changes to These Terms

Loan Factory may update these Terms from time to time. Material changes will be communicated via in-app notice or email. Continued use of the Service after changes take effect constitutes acceptance.
